Any felony conviction deprives you of your right to possess a firearm. It also suspends your right to vote, hold office and sit on a jury. But what people are most are concerned about is restoring their rights to possess firearms. Remember that after you have done your time in prison and supervised release or probation, you cannot carry a firearm. Just possessing a firearm is prohibited even if it is not used to commit any crime and will get you time in prison. Simple possession of a firearm, if your are a prohibited possessor, is a class 4 felony. If you have just one prior you are looking at a sentencing range of from 2.25 years to 7.5 years. The presumptive sentence, the one most frequently given is 4.5 years.
Is it possible to regain your gun rights after conviction?
There are a few conditions for getting your gun rights restored.
Non-Serious Offense
Your crime must have been designated as non- serious. Your sentencing paperwork will tell you if your crime was designated as a non-serious offense. If you completed your prison sentence and community service or your time in the county jail or your probation, you can apply to restore your gun rights two years after your sentence is completed.
Serious Offense
Your sentencing paperwork will tell you if your crime was designated as a serious offense. If you have committed a serious offense such as crimes against children or sexual offenses you must wait ten years before you can apply to restore your gun rights.
Dangerous Offense
If your conviction was designated dangerous, such as the discharge of a deadly weapon or the use of a deadly weapon to intentionally cause serious injury to someone, you can never get your gun rights restored.
