If your civil rights, including your gun rights, were suspended or lost as a result of a conviction in the state of Arizona, another state, or aFederal District Court in any State, I can get your rights restored. This is done by filing an application in the county in which you reside in Arizona. This includes gun rights, unless you have been convicted of what is called a serious or dangerous offense. Normally, your sentencing papers will state whether it was that type of offense.

If you have received an absolute discharge from imprisonment in any state or federal prison, or completed your probation in Arizona or any other place, I can get your rights restored in the Arizona court in the county in which you reside. This includes your gun rights. The only exception to gun rights restoration is if you have been convicted in Arizona of a dangerous or serious offense or one which the Arizona courts would consider this type of offense occurring in another state. In Arizona,
your sentencing documents will specifically state whether you were convicted of this type of offense.

If you don’t have your paperwork from a case that occurred in Arizona, I can get that and I can also get that information for a conviction for a federal crime any place in the United States. If you have been convicted of a state crime outside the state of Arizona access to the information depends on the state. There used to be a waiting period to apply for these rights, but in Arizona you no longer have to wait.

In addition to getting your rights restored, I can get your conviction set aside. This means the court will set aside the charges and dismiss them. You may also be entitled to a certificate of second chance, but in this case, certain time limits are involved. If you don’t ask for that, there is no waiting period. If the court grants the a certificate of second chance there are benefits. If you are issued this certificate it releases you from any disability for obtaining an occupational license, if required
under Arizona law. It also protects an employer from hiring an employee or contacting with an independent contractor who has been convicted of a felony. The certificate will also prohibit people from discriminating against you if you are trying to rent a house or apartment.

There are lots of advantages to getting your rights restored and your convictions set aside and dismissed. It will, in essence, give you a new start on life. If a prospective employer asks if you have been convicted of a felony you can prove that your conviction was set aside and the case was dismissed. In some cases, having your guns rights restored may even entitle you to secure the right to carry a concealed weapon upon applying to the Arizona Department of Public Safety.
